Last updated: October 24, 2023
Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the PayCrypt website and software services operated by PayCrypt Inc. ("us", "we", or "our").
1Acceptance of Terms
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. By creating an account, you agree to receive newsletters, marketing or promotional materials and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link.
2Description of Service
PayCrypt provides a crypto payment platform that allows merchants to accept cryptocurrency payments. We collect payments on your behalf; you view balances in your dashboard and withdraw to your wallet when you choose.
Custody of Funds
PayCrypt holds funds on your behalf as the merchant. We collect incoming payments, display balances in your dashboard, and process withdrawals to your designated wallet. You retain control over when and where to withdraw. Our systems are built for security and operational transparency.
We provide API access, dashboard analytics, and webhook notifications to facilitate payment monitoring and integration.
3Eligibility
To use our Service, you must be at least 18 years old and capable of forming a binding contract. By using the Service, you represent and warrant that you meet all eligibility requirements.
You further represent that you are not located in, or a national or resident of, any country subject to sanctions by the United States (such as OFAC sanctions), the European Union, or the United Nations.
4User Obligations
As a user of the PayCrypt platform, you agree to:
- Provide accurate and complete information during registration.
- Maintain the security of your account credentials and API keys.
- Ensure that your use of the Service complies with all applicable local, state, national, and international laws and regulations.
- Assume full responsibility for all taxes and fees associated with your cryptocurrency transactions.
You are strictly prohibited from using the Service for any illegal activities, including but not limited to money laundering, terrorist financing, or the purchase of illegal goods.
5Fees and Payments
PayCrypt charges a service fee for the use of our software, which is detailed on our Pricing page. We reserve the right to change our fees upon thirty (30) days' notice.
Network fees (gas fees) required to process transactions on the blockchain are the sole responsibility of the sender and are not included in PayCrypt's service fees.
6Limitation of Liability
In no event shall PayCrypt, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Service;
- Any conduct or content of any third party on the Service;
- Any content obtained from the Service;
- Unauthorized access, use or alteration of your transmissions or content.
As a payment service provider, we are not liable for funds lost due to user error (such as withdrawing to the wrong address), blockchain network failures, or circumstances outside our control.
7Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. Since we do not hold your funds, termination of your account does not affect your access to your cryptocurrency assets held in your own wallets.
